CONSTRUCTION OF A 132kV TRANSMISSION LINE FROM LONGYUAN MULILO DE AAAR MAANHAARBERG WIND ENERGY FACILITY TO THE HYDRA SUBSTATION IN DE AAR, NORTHERN CAPE PROVINCE: NOTIFICATION OF AMENDMENT OF THE ENVIRONMENTAL AUTHORISATION

Longyuan Mulilo De Aar Wind Power (RF) (Pty) Ltd (hereafter referred to as the Applicant) applied for an amendment of the Environmental Authorisation (EA) in terms of the National Environmental Management Act (No. 107 of 1998) (NEMA) and Environmental Impact Assessment (EIA) Regulations (2014) for the construction of a 132kV transmission line adjacent to the existing Eskom transmission line and associated infrastructure from Longyuan Mulilo De Aar Maanhaarberg Wind Energy Facility to the Hydra Substation in De Aar, within the Emthanjeni Local Municipality, Northern Cape Province.
All Interested and/or Affected Parties are hereby notified, on behalf of Longyuan Mulilo De Aar Wind Power (RF) (Pty) Ltd, that the Department of Environmental Affairs (DEA) has amended the Environmental Authorisation dated 11 August 2014 (by replacement) in terms of NEMA (Act No. 107 of 1998), for the construction of the transmission line and associated infrastructure.
The proposed project is located on the following farms Remainder of Portion 2 of Farm Zwartekopjes No.131; Remainder of Farm Zwartekopjes No.131; Portion 5 of Farm Zwartekopjes No.131; Remainder of Portion 1 of Farm Bosjemans Fountain No.136; Remainder of Farm Hartebeestplaat No.135; Portion 1 of Farm De Aar No.180; Remainder of Portion 2 of Farm De Aar No.180; Remainder of Portion 1 of Farm Vetlaagte No.4; Remainder of Farm Wag ‘n Bietjie Annex A No.138; Portion 3 of Farm Wagt en Bittje No.5 and Farm Hydra No.144, within the Emthanjeni Local Municipality, Northern Cape Province.
DEA has decided to grant authorisation for the second issue of the Environmental Authorisation (which will replace the previous EA dated 11 August 2014 in terms of Regulation 27(2)(b), making the EA dated 11 August 2014 null and void) to undertake the following activities listed in terms of 2014 EIA Regulations: Activities 11, 12 and 19 of GN R983. Amendments to the EA (since the previous EA dated 11 August 2014) include the following: 1) Re-alignment of a section of the transmission line near the Hydra substation; 2) Amendment to the monopole footprints; 3) Amendment of Condition 1 of the first issue EA (updated to incorporate the re-alignment of the section of the line near to the Hydra Substation, as indicated in the Application for Amendment of the EA (date of application, 2015)); 4) Correction of typographical/ editorial errors in the EA. We would like to draw your attention to your right to appeal against the decision to the Minister of Environmental Affairs in terms of NEMA (No. 107 of 1998) read with the National Appeal Regulations, 2014 ( GN R. 993). In this regard, your attention is drawn to Chapter 2 of Government Notice No. 993, which prescribes the appeal procedure to be followed. An appellant must submit an appeal to the appeal administrator, and a copy of the appeal to the Applicant, any registered Interested and Affected Party and any organ of state with interest in the matter, within 20 days from the date that the notification of the decision was sent to the registered interested and affected parties by the Applicant, by means of one of the following methods:
